Terms of Use

01Eligibility

• ·You must be at least 18 years old.
• ·Agent and agency users must hold valid state-required Medicare licenses appropriate to the activities performed in the service.
• ·You are responsible for compliance with CMS Marketing Guidelines, AHIP, and applicable state insurance laws regardless of the service's features.

02Accounts and access

• ·Provide accurate registration information and keep credentials confidential.
• ·You are responsible for activity under your account and for the actions of users you authorize.
• ·Notify us immediately of unauthorized access at security@theartificialbridge.com.
• ·We may suspend or terminate accounts engaged in fraud, abuse, or material non-compliance.

03Acceptable use

• ·No use that violates law, including telemarketing, robocall, two-party-consent recording, anti-kickback, or CMS rules.
• ·No reverse-engineering, scraping, or attempting to extract our models or proprietary data.
• ·No upload of malware, infringing content, or content you lack rights to.
• ·No use of the service to make automated benefit-eligibility or coverage decisions about a Medicare beneficiary in a way prohibited by CMS or applicable law.
• ·No circumvention of usage caps, rate limits, or access controls.

04Subscriptions, fees, and renewals

• ·Fees are described on the order form, /pricing, or in your administrator's agreement.
• ·Monthly subscriptions auto-renew until cancelled. Annual subscriptions auto-renew unless cancelled at least 30 days before the renewal date.
• ·Usage overages (e.g., calls above included caps) are billed in arrears at the rates in your order form.
• ·Fees are non-refundable except as required by law or expressly stated in your order form.
• ·We may change prices on renewal with 30 days' notice.

05Customer data and ownership

You retain all rights to data you submit to the service ("Customer Data"). You grant us a limited license to host, process, and display Customer Data to provide the service and to develop aggregated, de-identified insights. We will not sell Customer Data and will use PHI only as permitted by the applicable BAA.

06AI outputs and human responsibility

• ·The service generates suggestions, summaries, and predictions using AI models. Outputs may be incomplete, inaccurate, or out of date.
• ·You — not the service — remain responsible for advice given to beneficiaries, plan recommendations, enrollments, disclosures, compliance posture, and CMS filings.
• ·complianceBRIDGE flags potential CTM and Marketing Guideline issues but does not constitute legal or compliance advice and does not guarantee CMS outcomes.
• ·Do not rely on the service for emergency, clinical, or life-safety decisions.

07Intellectual property

Artificial Bridge LLC and its licensors own the service, models, training data, software, and brand. No rights are granted except those expressly stated. Feedback you provide may be used by us without obligation.

08Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTIFICIAL BRIDGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLIANT WITH ANY SPECIFIC REGULATORY STANDARD.

09Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING OUT OF THESE TERMS OR THE SERVICE. EACH PARTY'S AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE FEES PAID OR PAYABLE BY YOU TO ARTIFICIAL BRIDGE FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10Indemnification

You will defend and indemnify Artificial Bridge against third-party claims arising from your Customer Data, your violation of these Terms or applicable law, or your use of the service in violation of CMS or insurance regulations.

11Termination

You may terminate by cancelling your subscription. We may terminate or suspend access for material breach, non-payment, fraud, abuse, or to comply with law. Sections that by their nature should survive termination will survive.

12Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Exclusive venue lies in the state and federal courts located in Collin County, Texas, except where applicable law gives consumers a right to bring claims elsewhere.

13Changes

We may update these Terms from time to time. Material changes will be posted with a new effective date and, where appropriate, additional notice. Continued use after the effective date constitutes acceptance.
